1. About Easywill
Easywill ('Easywill', 'we', 'us', 'our') is a document service — not a law firm — and we do not provide legal advice.
We provide tools to help New Zealanders create their own will documents. By using Easywill you agree to these terms. If you do not agree, please do not use our service.

2. Who can use Easywill
To use Easywill you must:
- Be 18 years of age or older
- Be a resident of New Zealand
- Be creating a will for your own personal use
- Provide accurate and truthful information
Easywill is designed for straightforward NZ estates. It may not be suitable if you have complex circumstances — see section 7 for guidance on when to seek independent legal advice.
3. What we provide
3.1 Will creation tools
We provide a structured questionnaire that helps you create a will document based on your answers. You remain responsible for the accuracy of all information you provide.
3.2 Will document (PDF)
We generate a PDF will document based on your answers. This document is based on templates developed with reference to New Zealand law, including the Wills Act 2007 (NZ).
3.3 Statement of Assets (members only)
Easywill Members receive access to a Statement of Assets — a non-legal executor reference document separate from the will. See section 6 for important information about this document.
3.4 Document delivery
We deliver your will document to the email address you provide. Delivery is subject to your email provider accepting the message.
4. What we do not provide
4.1 Legal advice
Nothing on our platform, in our documents, or from our support tools constitutes legal advice. If you need legal advice about your will or estate, please consult a qualified NZ solicitor.
4.2 Guarantee of validity
We do not guarantee that your will is valid or enforceable. The validity of a will depends on many factors including how it is signed and witnessed, your mental capacity at the time of signing, and your specific circumstances.
4.3 Verification of capacity or identity
We do not verify your mental capacity, testamentary capacity, identity, or whether you are acting freely without undue influence or coercion.
4.4 Legal representation
We do not act as your solicitor or legal representative in any capacity.
5. Plans and pricing
5.1 Annual membership
Easywill membership costs $29 NZD per year and provides:
- One will document (PDF) with signing instructions
- Unlimited will updates while your membership is active
- Statement of Assets (non-legal executor reference)
- Annual review reminders
- NZ law change notifications
Annual membership renews automatically each year. We will notify you by email at least 7 days before your renewal date. You may cancel at any time before renewal to avoid being charged for the next year.
5.2 Refunds
Because will documents are generated and delivered immediately upon payment, we do not generally offer refunds once your document has been delivered. If you experience a technical failure that prevents delivery of your document, please contact help@easywill.life and we will make it right.
Nothing in this section limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
6. Statement of Assets
The Statement of Assets is a non-legal executor reference document available to Easywill Members. You must understand:
6.1 Not a legal document
The Statement of Assets is not a will, codicil, or any other testamentary document. It has no legal effect and does not form part of your will.
6.2 Not binding
Your executor is not legally obligated to follow the Statement of Assets. It is provided as a practical reference to help your executor locate your assets.
6.3 Your responsibility
You are responsible for keeping your Statement of Assets accurate and up to date. We do not verify any of the information you enter.
6.4 Security
Do not store passwords, PINs, or sensitive access credentials in your Statement of Assets. Store these separately in a secure location.
6.5 If membership ends
If your annual membership ends, you will retain access to view and download your existing Statement of Assets but will not be able to update it without renewing.
7. When you should seek independent legal advice
Easywill may not be suitable for your circumstances. You should consult a qualified NZ solicitor if:
- You have assets or property outside New Zealand
- You want to exclude a close family member from your will
- You or a beneficiary has a condition affecting mental capacity
- You operate a business or have significant business interests
- You have children from a previous relationship
- You have a family trust
- Your estate involves Māori land (Te Ture Whenua Māori Act 1993 may apply)
- You have substantial overseas assets or international connections
- Your relationship property situation is complex
- You have any doubt about whether Easywill is right for you

8. Wills disclaimer
8.1 Document service only
Easywill is a document service that provides document preparation tools only. We are not a law firm. The information on our platform and in our documents does not constitute legal advice and is not a substitute for legal advice.
8.2 No warranty of validity
We make no representation or warranty that your will is legally valid, enforceable, or appropriate for your circumstances. Whether a will is valid depends on factors we cannot verify including your mental capacity, how it is signed, and your specific personal circumstances.
8.3 Legislative changes
Laws affecting wills change over time. We cannot guarantee that our templates will reflect every legislative change immediately. We endeavour to update our templates when we become aware of relevant changes to the Wills Act 2007 (NZ) and related legislation, but we accept no liability for any impact of legislative changes on your will.
8.4 Overseas assets
Our wills are designed for New Zealand assets only. If you have assets outside New Zealand, your NZ will may not automatically cover them. You should seek independent legal advice regarding overseas assets.
8.5 Your responsibility
You are responsible for:
- The accuracy of all information you provide
- Reading and reviewing your will before signing
- Correctly signing and witnessing your will
- Storing your will safely
- Updating your will when your circumstances change
9. Data and privacy
9.1 What we store
We store the information you provide to create your will, including your personal details, your beneficiaries' details, and your will answers. We also store your will documents.
9.2 How long we keep it
We retain your data while your account is active. If you request account deletion, we will delete your personal data within 30 days, subject to any legal requirements to retain certain records.
9.3 Your rights
Under the Privacy Act 2020 (NZ) you have the right to access and correct personal information we hold about you. Contact help@easywill.life to exercise these rights.
9.4 Full privacy policy
Our full Privacy Policy explains how we collect, use, and protect your information.
9.5 Email communications
By creating an account you consent to receive transactional emails about your will and account. You may opt out of non-essential marketing emails at any time.
10. Intellectual property
10.1 Our content
The Easywill platform, templates, design, and content are owned by Easywill and are protected by copyright law. You may not copy, reproduce, or use our templates for any purpose other than creating your own personal will.
10.2 Your will document
The will document generated for you belongs to you. You may print, store, and use it as your legal will.
10.3 Your data
You own the personal information you provide. By using Easywill you grant us a licence to process this information to provide our services.
11. Liability
To the maximum extent permitted by NZ law, Easywill's liability to you for any claim arising from your use of our service is limited to the amount you paid us in the 12 months before the claim arose.
We are not liable for:
- Any loss arising from your will being invalid or unenforceable
- Any indirect or consequential loss
- Any loss arising from information you provided being inaccurate
- Any loss arising from failure to sign or witness your will correctly
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

12. Governing law
These terms are governed by the laws of New Zealand. Any dispute arising from your use of Easywill will be subject to the exclusive jurisdiction of the New Zealand courts.
13. Changes to these terms
We may update these terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Your continued use of Easywill after that date constitutes acceptance of the updated terms.
